ORANGE COUNTY NOISE CONTROL ORDINANCE

FACT SHEET

  • This ordinance (Chapter 15- Article V) purpose is to regulate and prevent excessive and unnecessary noise, known as noise disturbance in order to protect the health, safety and general welfare of the people of the county.
  • Enforcement/penalty per Orange County Sheriff Deputy Bridges:
    • The plainly audible standard allows the Sheriff’s Office to investigate noise disturbances complaints emanating from residential property that exceeds the allowable noise limits that may involve the consumption of alcohol, any suspected illegal activities and disturbances involving a “breach of the peace”.
      • When a noise complaint is received, and upon personal investigation by an Orange County Sheriff, finds probable cause that the owner of the real property at issue is in violation, the investigating officer will issue a notice of violation. (Verbal warning).
      • If the owner of the real property does not take corrective action to cease and desist within fifteen (15) minutes or less OR;
        • If the noise ceases after the Notice of Violation warning and then REOCCURS within the same day/evening, the investigation officer shall promptly issue a civil citation or criminal citation, punishable by a fine of two hundred dollars ($200.00) for the first offense and four hundred dollars ($400.00) for the second offense.
      • A third and each subsequent violation requires a mandatory court appearance and may be punishable by a fine of five hundred dollars ($500.00) plus all costs incurred by the county including attorneys’ fees and investigative and court costs.
